TERMS AND CONDITIONS

  1. Application

    • Sounds and Pressure (also known as “S&P”) is range of equipment manufactured by Phillip Bush Engineering (“PBE”).

    • The following terms and conditions (referred to as "the Terms") apply to all purchases made from PBE by the Customer (“you / your”). By placing an order, you are making an offer to PBE (referred to as "us / we / our") to purchase the items ordered subject to the Terms.  The offer is only accepted when we acknowledge and accept in writing receipt of a payment by you of a deposit or payment in full as an order.

  2. General.

    • PBE reserves the right to refuse sale to anyone.

    • UK sales are subject to VAT at the current UK full rate at the time of invoice.

    • Prices shown and payments are in £ UK.

    • PBE is not responsible for transaction fees, exchange rate fess or any other additional charges.

    • Warranty period is one year and excludes damage due to misuse.

    • Warranty period commences when the customer receives the goods.

    • Warranty is not transferrable.

    • Warranty applies to the equipment purchased from PBE only; PBE will take no responsibility for damage to other equipment.

  3. Ordering

    • An order is placed for a custom or hand-built product when a deposit is received and accepted in writing by us as an order.

    • Occasionally PBE will sell pre-built, new products off the shelf. In this instance an order is placed when full payment is received and the goods are despatched.

    • When ordering custom-built S&P products, the Customer is required to complete a Specification Document which will be provided to the Customer. This document forms the specification of the S&P product to be built. The content of the Specification Document supersedes any prior communication, written or verbal, regarding specification, so it is especially important that this document is a complete, clear and accurate description of the Customer’s requirements.

    • Any subsequent changes to the Specification Document must be agreed in writing between PBE and the Customer. Subsequent changes may incur additional charges which will be communicated as soon as known.

    • Ordering from outside the UK may be subject to additional local charges, such as but not exclusively import duties, any customs charges, or any other taxes. These and any such charges are the responsibility of the Customer to pay. It is the Customer’s responsibility to check the application and value of these charges.

  4. Shipping.

    • Shipping charges, including insurance, will be paid by the Customer prior to despatch.

    • Shipping is fully insured unless with prior written agreement. In the event of any loss or damage, the liability of PBE is limited to the insured value.

    • Shipments may be subject to opening and inspection by authorities. In the instance of goods dispatched to the Customer, to an address outside of the UK, the Customer is deemed to be the importer of the goods. The Customer must therefore comply with all the laws and regulations of the country into which the goods are being delivered.

    • A valid signature will be required on delivery.

    • PBE shall have no liability to the Customer for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance.

    • If your shipping package is returned to us because you have not taken delivery, we will contact you to let you know. If the package has been returned to us because the Customer provided an incorrect delivery address, or failed to take delivery, or failed to pay import charges, or for any other reason that can reasonably be said to be the fault of the Customer, any rearranged delivery will be subject to the Customer paying: The additional delivery cost; and any other charges PBE may have incurred to receive the returned package.

  5. Item condition.

    • Unless specified otherwise, all items sold are custom and / or hand-built. As such, there may be minor blemishes to paint, polished or any other finishes or external features, consummate with manual production methods.

    • The images of the products on our website are for illustration only. Colours, knob designs, and other external features may vary slightly.

  6. Cancellations, returns and refunds.

    • All Customers have the right to cancel their order under the Consumer Rights Act. Customers must inform PBE in writing about cancelling the order within 14 days of placing the order.

    • Occasionally PBE will sell pre-built, new products off the shelf. In this instance the 14 days period commences when the Customer has received the goods. The Customer must take all reasonable care of the goods and the goods must be sent back to PBE soon as the order is cancelled. The Customer is responsible for all shipping costs.

    • PBE reserves the right to make a charge not exceeding our direct costs of recovering the goods if the Customer does not return the goods or returns them at our expense.

    • The customer is responsible for all shipping costs, including insurance, for all goods returned to PBE or subsequently returned to the customer for any reason. 

    • Goods returned must be in the original condition. In the event of goods not being returned in original condition, PBE reserves the right to charge for costs associated with any rework of the goods necessary to return them to original condition or conditional appropriate to age of goods.

    • There is no right to cancel an order 14 days after receipt if the supply of goods are made to the customer's specification or are personalised in any way.

    • Items being returned from countries outside of the UK.

      • You will need to complete a customs form. It is the Customer’s responsibility to declare and accurately describe the goods being returned on all shipment documentation.

      • It is the customers responsibility to correctly state if the goods are being returned for refund, exchange, warranty repair or other reason. If this is not declared the parcel may get delayed in customs or be returned to you.

      • It is the Customer’s responsibility to correctly declare on the shipment documentation a reasonable value of the goods being returned.

      • PBE will not pay any customs, import, tax, or any other charges on returned goods which are declared incorrectly. The goods shipment will be deemed not delivered to PBE and will likely be returned to you or stored in customs.

      • PBE will not issue any refunds on returned goods that are not returned and delivered to PBE.

 

This agreement shall be deemed to have been made in England and shall be governed by the laws of England and Wales.
